Basus Home Ltd - Terms & Conditions of Sale & Supply of Goods

 

Definitions "Bespoke Items" and "Made to Measure Items": Goods which are made-to-measure or made to your specifications, custom-made or made-to-measure, or otherwise customised or personalised. "Contract": the contract for the purchase and sale of the Goods. "Goods" and “Items”: any products which we make available for sale. "Event(s) Outside Our Control": Any act or event beyond our reasonable control which may inhibit or prevent production or delivery of Goods. These acts and events may include, without limitation, third party industrial action including strikes, lock-outs or other industrial action; civil action including civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, natural disasters, pandemics or epidemics which affect the manufacture & supply chain of Goods, failure of public or private telecommunications networks; and inability to use the railways, shipping, aircraft, motor transport or other means of public or private transport. “Seller”, “us” & “we”: Basus Home Ltd. “Customer”, “buyer” & “you”: the individual who is purchasing Goods from Basus Home Ltd. "Order": an order for Goods which you submit to us. "Terms": Terms and Conditions of sale of Basus Home Ltd. Accuracy of Order Information It is the customer’s responsibility to ensure that they are satisfied that all details noted on receipt with regards to particular models and finishes are correct. Any alterations to models or finishes must be made within 24 hours of date of receipt.  Purchase of products The seller is not obliged to accept your Order. We reserve the right to decline all or part of any Order for any reason. This could be, for example, that the Goods are not in stock or are no longer available or because of a pricing error. If we decline all or part of your Order, we will contact you with additional information and will not process your order. We will refund the full amount of your payment if you do not wish to order alternative Goods from us or; in the case of a pricing error, order the Goods at the correct price. If we do cancel your order, we will notify you by email and will refund to you any sum paid by you to us in respect of the contract as soon as possible, and in any event within 30 days of the cancellation of your order. The creation of the contract between the customer and the seller will take place upon the successful delivery or collection of any part of your order unless we have notified you that we do not accept your order as outlined above. Images & specifications Goods displayed on the seller’s website are for illustrative purposes only. They may not be representative of the actual size of the Goods. We cannot guarantee that the way in which your computer displays colours will accurately reflect the colours of the Goods. The product pictures represented onsite are a guideline. We reserve the right to alter the Goods or any relative specifications (whether or not these specifications were submitted by the customer when Order was placed, at any time, if we are required to do so by law. If this happens, we will notify you as soon as possible. Contract: If we accept your Order, these Terms will form the basis of the Contract between us. You should print a copy of these Terms or otherwise save them for future reference. You should also retain your copy of the original receipt. Consumer Rights As a consumer, you have legal rights in relation to Goods that are faulty or not as described. Contact your Citizens' Advice Bureau or Trading Standards Office for more information. These Terms do not affect your legal rights. A manufacturer's guarantee also applies to some of the Goods we sell. Please ask for full details of any manufacturers guarantee. Deposits All deposits paid are non-refundable. This includes standard products ordered especially for the customer and also to non-standard items (Bespoke/Custom-Made/Customised/Made-to-Measure/Personalised items). Goods ordered in a customer’s specific choice of size, colour, wood finish, fabric, leather, etc are considered non-standard/bespoke. Acceptance of goods The customer shall be deemed to have accepted goods within 24 hours of delivery & cannot reject goods after acceptance. The customer must sign the delivery note upon delivery, acknowledging receipt of the goods, state of packaging & any damage or missing/incorrect items. If goods are not inspected upon delivery, the client must state clearly in writing upon the said delivery note that the goods have not been inspected. Failure to do so will indicate that the goods have been accepted without defect. Any damages or missing/incorrect items must be reported to the seller in writing by email within 1 day of delivery being received. Digital photographs must be supplied where appropriate to ensure resolution of any problem. Returns and exchanges are not accepted unless agreed in advance with the seller that an incorrect item has been supplied. Ex-display Ex-display items are 'sold as seen'. It is the customer's responsibility to ensure they are entirely satisfied with condition prior to delivery/collection of same. Delivery/Collection We will deliver the goods you have ordered to the address you give us for delivery at the time you place your order. Delivery charges may apply and these will be stated at the time of ordering, if applicable, on the order receipt. We aim to deliver or enable you to collect your furniture within the time quoted. Please note, all delivery dates and lead-times quoted are given in good faith and are approximate at the time of placing your order, based on the estimated length of time that we believe we can deliver the order to you and upon stock levels and/or delivery times provided to us from our suppliers. Orders may be affected by delays that are beyond our control and therefore we cannot accept responsibility for any consequential loss. All delivery dates quoted, either verbally or in writing, are approximate and do not form part of the Agreement or Contract. As such, variations may occur. Where multiple items have been ordered, we will endeavour to deliver them all together before the longest delivery time quoted, unless a split delivery is specifically requested. A requested split delivery may be subject to a further delivery charge. Once your complete order has been received by us, you will be contacted to arrange a delivery or collection date. As our storage facilities are limited and for transit purposes only, we will endeavour to deliver your order to you as swiftly as possible and ask that you accept delivery of your order on this basis. Only the person who placed the order can collect the order; it cannot be collected by anybody else on your behalf, unless otherwise agreed in advance by all parties. We do not have the storage capacity to hold customers’ items for any extended periods of time. If you are unable to take delivery or collect your order within 7 days after it becomes available, a weekly storage charge may be applied. Delivery access It is the customer’s responsibility to ensure easy access to the room of choice and that items will fit through any passages, access gates, stairwells, landings and internal doors. Prior to your delivery, please ensure the route is clear and free from any obstructions. Please note that there will be an additional charge for failed delivery; where the failure to deliver is no fault of the Seller. Ownership of goods Title of ownership of goods remains the property of Basus Home Ltd until paid for in full. The customer will become the owner of the goods at the time of delivery/collection, provided we have received payment in full. General If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these terms and conditions will not be affected. Each section of these Terms operates separately. If any of these sections (or any part of any section) is found by any court or relevant authority to be unlawful or unenforceable, the other sections (or part of the section in question) shall not be affected and shall remain in full force and effect. If any section of these Terms is found to be unlawful or unenforceable but would be lawful and enforceable if some part of the section were deleted, the section in question shall apply with such deletion as may be necessary to make it lawful and enforceable. We will not be responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract which are caused by an Event outside Our Control. If an event outside our control takes place that affects our Contract with you, we will contact you as soon as reasonably possible to notify you. Please note our obligations under a Contract will be suspended for the duration of the Event Outside Our Control. Neither the Seller nor the Customer may alter the terms of any agreement without the agreement in writing of the other.
